Travel Club Terms and Conditions |
| Description
of Membership: travelgods.net's Travel Club membership
is provided by travelgods.net, a dba of E3P Holdings LLC. Membership shall
remain valid so long as the annual membership fees are paid. Membership
is available to all those who have a valid credit card, are able to
travel via commercial or private conveyance unassisted, and agree
to the terms and conditions of membership. Club program memberships and their benefits are offered
at the sole discretion of travelgods.net. The rights and obligations
under this program may be assigned or transferred by travelgods.net
to any other related or unrelated entity at any time, and performance
thereafter shall be the responsibility of that entity. |
| Membership
Fees: The payment of initial administrative or annual membership or renewal fees initiates
club membership. All payments are
electronically charged to a credit or debit card for membership or
renewal fees and this transaction is an indication of the acceptance
of these terms and conditions. |
| Membership
Eligibility: Participation in the Travel Club program is available
to individuals (“you”) as stated in these terms and conditions.
You may maintain only one account. Other entities, such as companies,
cannot enroll without written permission from travelgods.net, and
Club membership is not transferable to another
person for any reason. Program entrance requires travelgods.net website registration and only travel activites purchased and coordinated through travelgods.net is eligible for earned travel reward credit. |
| Memberships
Levels: There is only one Travel Club membership level and members receive travel credits
for member travel that is booked through travelgods.net. Guest(s) travel may be eligible for earned member credit if that travel is arranged in conjunction with and meant to accompany member(s). Only bookings reserved with one credit card and online through
travelgods.net's website, email, or via the phone with our travelgods.net staff qualify
for credit. travelgods.net will quote credits at time of reservation
and will periodically confirm credits upon completion of travel. Cancelled bookings or trips for any reason are not eligible for members to earn Travel Club credit. Membership is renewable
and is not transferable to another individual. Advanced planning is essential to guarantee location,
availability, and other coordinated services. Members must be on a valid vacation in
a tourist status. All international VISA and immigration laws, rules,
and policies are applicable and mandatory for Travel Club participation. |
| Travel Club
Program Usage: Members must use and coordinate travel-related
activities via travelgods.net to earn and redeem travel credits. In some cases, and depending on the
travel activity, a deposit may be required for an activity before
an actual reservation is made. Rate increases and black out dates
may apply due to holidays and other heavily trafficked times; all as may be determined by travelgods.net
in its sole discretion. |
| Program
Availability: Advanced planning is essential to guarantee location,
availability, and other coordinated services. travelgods.net reserves
the right to restrict, suspend, discontinue or cancel this program
upon 90 day written notice to all active members. In that event, your
right to receive Travel Club travel credits may end 30 days after we
notify you, and your right to redeem Travel Club credits may end
90 days after we notify you. travelgods.net's Travel Club credits not presented
for redemption on or before such redemption end date cannot be redeemed. Travel Club travel credits can only be redeemed by current Travel Club members in good standing, as well as meet all the applicable terms and conditions. |
| Program
Cancellation: travelgods.net reserves the right to cancel
any portion of travelgods.net's Travel Club membership and revoke any and all unredeemed
Travel Club Credits collected by any member for reasons that include,
but are not limited to: 1) violation of these terms and conditions;
2) misrepresentation of any information or any misuse of this program;
3) violation of any international, national, state or local law or
regulation in connection with the use of membership privileges; 4)
failure to pay membership or renewal fees; 5) a check or credit card
payment to travelgods.net or any participating travel partner that
is returned for insufficient funds or is invalid for any reason; 6)
commission of fraud or abuse involving any portion of this Travel Club membership; 7) more than one active account per member; or 8) action,
in any other way, to the detriment of travelgods.net's Travel Club, travelgods.net,
or any of its alliances; all as may be determined by travelgods.net
in its sole discretion. |
| Accumulating
Travel Credits and Maximum Balance: You may earn travelgods.net Travel Club Credits only upon booking and undertaking travel activities
from travelgods.net directly. Travel Club Credits will not
be earned for stays made prior to the date of your enrollment as shown
in our records; or for travel coordinated outside of travelgods.net’s
purview. Specific travel parameters that may affect travel credits
will be stated at the time reservations are arranged. There are no
stated limits on maximum Travel Club Credits and have no pre-stated
expiration date. |
| Limits
on Travel Credits for Stays: travelgods.net Travel Club Credits are
not earned for stays that were not purchased through travelgods.net.
Travel Club membership benefits can be combined with other travel reward and incentive programs. travelgods.net Travel Club Credits cannot be used to pay for taxes and other incidental fees, as may be determined by travelgods.net
in its sole discretion. |
| Travel
Credits have No Value: travelgods.net's Travel Club Credits are not redeemable
for cash or any other form of credit and have no value until presented
for redemption in accordance with the terms and conditions of travelgods.net's Travel Club membership. travelgods.net's Travel Club Credits have no fixed or ascertainable
cash value. Members have no ownership interest in accrued points and
accrued points do not constitute property of the members. Use of the
word "earn" in marketing materials in relation to Travel Club Credits shall mean "collect" and shall not infer
that the travelgods.net's Travel Club Credits have any value until they are presented
for redemption. travelgods.net's Travel Club Credits may not be purchased or sold
and are not transferable except as otherwise stated herein. |
| Communications
Not Received: travelgods.net is not liable for loss of
misdirected correspondence, requests, freight, or Reward Certificates
that may be incomplete, illegal, delayed, lost or stolen. |
| Travel
Credits Usage Procedures: Members can redeem Travel Club travel
credits for usage by calling the Service Center at +1 (800) 782-2135
or emailing sales@travelgods.net. Members must have the required number
of Travel Club travel credits in their account prior to redeeming points
for a reward. Information containing specific product or service details,
warranties and any restrictions are available for selected merchandise
from travelgods.net at travel coordination time. It is important
to check this information prior to redeeming your reward. Certain
restrictions may apply (particularly on travel-related rewards), such
as blackout dates, day-of-week usage, seating or room availability/allocation,
participating locations, expiration dates and other factors that may
affect use of the reward. |
| Purchased
Travel Services: The following general terms and conditions
apply, however regional circumstances and regulations, contractual
obligations to suppliers, and matters relating to location, product
type and supply logistics may cause these to be varied slightly for
specific products, or specific destinations. Some bookings
may require full payment at the time of confirmation. Deposit conditions for
certain accommodations, high travel periods and tour products may
vary, and member will be notified at time of booking. Final payment conditions for certain accommodation, high travel

| Cancellation:
Members may cancel travel arrangements
at any time, in accordance with the applicable terms and conditions agreed upon at confirmation. A written notification from the person who signed the
reservation may be required by travelgods.net prior to canceling
any travel arrangement. For
certain hotels, flights, entertainment packages and tours etc., the
cancellation fee may be higher. Please contact us for details. Depending
on the reason for cancellation, you may be able to reclaim these cancellation
fees less any excesses under the terms of your insurance policy. Cancellation
charges must however be paid before they can be claimed from insurers.
Please note that some airline tickets have a 100% nonrefundable fee.
Cancellations must be in writing and can be provided to travelgods.net electronically. Any cancellation
must be made with a live representative on the phone or in writing in order to avoid or assess any cancellation fees.
Members may write to travelgods.net, in care of Travel Club Member
Service, 411 SW. 12th Avenue, Suite 307, Portland, OR, USA 97205. Rate
increases and black out dates may apply due to special events, holidays
and other heavily trafficked times; all as may be determined by travelgods.net
in its sole discretion. |
| Travel
Insurance: travelgods.net strongly recommends that Travel Club members
purchase a comprehensive travel protection plan both for protection
against emergencies which may occur, and for your own peace of mind.
We can offer excellent travel protection plans, details of which are
available on our website or upon written or verbal request. |
| Returned,
NSF ACH Payments and Over the Limit Payments: In the event that any
enrollment fee or other required payment is returned due to over the limit reasons, travelgods.net may immediately attempt to collect the amount by presenting
the credit card charge a second time or third time to your original
banking institution. Any member with negative payment history may be
subject to a higher deposit on any future financed travel or services. |
| Notice
of Changes: Any such changes will be shown in these terms
and conditions on the Travel Club membership web site and will be effective
immediately unless stated otherwise. A notice that a change has been
made will be placed on the web site for a reasonable period of time.
Any changes to any printed version of the Terms and Conditions will
be contained in the next reprinting of that printed version. travelgods.net will attempt to notify active members of major program
changes, but will not be liable for failure to do so, and all members
will nevertheless be bound. |
| Membership
Terms: Travel Club memberships are effective for a period of 12 months
following enrollment date under the annual membership plan. Each year
members will be notified by email and/or mail 30 days prior to the renewal date. travelgods.net reserves the right to increase or
decrease the membership fee for each new membership term. |
| Default
on Account: travelgods.net Travel Club members are in default if: a) they fail to pay any
applicable fee when due; or b) they breach any of the terms and conditions
of this or other travel-related agreements. If a member is in default, then upon compliance
with applicable law, travelgods.net has the right to: a) demand
the entire payment of any unpaid balance on the account immediately; b)
apply monies received on subsequent purchases to any delinquent account
balance owed including late fees if applicable; and/or c) proceed
with legal action. |
| Identity
Protection: All members purchasing any travel or services
may be required to provide travelgods.net the following documentation
for Identity, Residence and Employment verification purposes only:
a photocopy of valid state issued driver's license or identification
card or passport. If the documentation sent by you fails to satisfy
these requirements to our satisfaction we reserve the right to refuse
service to anyone at anytime. The above requirements are meant to
protect you the member and us against identity theft and fraud. |
| Legal
Rights: Neither the travelgods.net Travel Club program nor any benefit offered by the
Program creates, constitutes or gives rise to any legal or contractual
rights by members against travelgods.net or it’s parent company. |
| Responsibility
and Liability: travelgods.net, (a dba acting through its
parent company E3P Holdings LLC) shall have no liability in regard
to any services provided by any vendor. You agree that any claim with
regard to transportation and travel services shall be made against
the vendor of such services and not travelgods.net; travelgods.net's sole obligation hereunder shall be to forward to the vendor
all payments for services ordered and forward to you all the necessary
travel documents. The hotels, ground and air carriers, and other travel
providers which supply services in connection with these vacations
are independent contractors and are not agents of travelgods.net.
All coupons, receipts, passes, and tickets issued by hotels, carriers
and other suppliers are issued on the terms and conditions specified
by the suppliers. travelgods.net does not have the authority to
alter those terms. travelgods.net is not responsible for personal
injuries, loss or damage of property, inconvenience or expense resulting
from matters beyond its control, such as, acts of terrorism, defects
in vehicles, breakdowns in equipment, government actions, strikes,
theft, changes in itinerary or schedules, inclement weather and acts
of God. travelgods.net may, in its sole judgment, make any changes
and cancellations to this program that it believes
necessary. Travel benefits within the travelgods.net Travel Club membership program may be subject to separate terms and
conditions and may be altered or substituted with products or services
of equal or better value without prior notice to a member. |
| NEITHER
travelgods.net NOR ANY OF ITS INFORMATION PROVIDERS, PARENTS, MEMBERS,
SUBSIDIARIES, AFFILIATES, SERVICE PROVIDERS, LICENSORS, OFFICERS,
DIRECTORS OR EMPLOYEES SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL,
SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS
AGREEMENT; OR RESULTING FROM THE USE OR THE INABILITY TO USE THE SITE,
INCLUDING BUT NOT LIMITED TO: DAMAGES FOR LOSS OF PROFITS, USE, DATA
OR OTHER INTANGIBLE DAMAGES, EVEN IF SUCH PARTY HAS BEEN ADVISED OF
THE POSSIBILITY OF SUCH DAMAGES. |

and support customer travel. To the maximum extent possible, our planning
and coordinating services are delivered via the internet. This
